Terms of Sale & Affidavit of Purchase
The sale will be conducted as an auction with the obligation to purchase going to the highest bidder. The minimum bid will include the total amount of delinquent taxes, interest, fees, maintenance, advertising and other costs. The County Treasurer reserves the right to hold up to two more auctions to offer properties that do not sell at the first auction. Properties with a minimum bid price of less than $1,000 will be bid in $50 increments; minimum bids greater than $999 will be bid in $100 increments. Bids greater than $10,000 will be in increments of $500. Bids must be made in person, sealed bids are not allowed. An oral bid accepted at a public auction is a binding contract to purchase a parcel.
The 2025 Summer taxes will be collected in addition to the winning bid on auction night. 2025 Winter taxes are the responsibility of the purchaser. A bill will be sent to the winning bidder in early December 2025.
It is the goal of your County Treasurer to sell the parcels and have them back on the tax rolls. Bid numbers will be distributed beginning at 4:15 p.m. the day of the sale. Only the successful bidders will need to provide a valid driver's license or state issued identification card. Our office will check for delinquent taxes prior to issuing a bid number.
Each successful bidder must sign an Affidavit in accordance to MCL 211.78m(2), as amended by 2014 PA 501 stating that they do not hold a de minimus interest in any property in Midland County with delinquent taxes owing and that they are not directly or indirectly responsible for any unpaid civil fines for a violation of a city ordinance adopted under MCL 117.4l (including motor vehicle, parking, and blight violations.)
Payment is expected the night of the auction. We accept cash, check, certified check, bank approval letter and credit card. There is a 2.75% fee charged for payments made by credit or debit card, in addition to the sale price of the property, through our third party credit card provider, GovPros. Cash buyers will receive keys/access to property at the time full payment is received.
Persons holding interest in the property at the time of foreclosure must pay at least the original minimum bid the property was offered for at the 1st auction, regardless of which sale it is sold, before receiving a deed to the property.
The Office of the Midland County Treasurer and its staff cannot give out legal advice. Please research each property on your own behalf. The Midland County Treasurer does not guarantee accessibility, easements or building capabilities. Title Insurance is the responsibility of the buyer and availability is not guaranteed by the Midland County Treasurer. Property may be subject to Township/City codes and enforcement and the responsibility to comply will be that of the buyer.

Property may be removed from sale at any time due to unforeseen circumstances.

Foreclosure Sale Proceeds Claims

If a property was sold at tax foreclosure, those who hold title or equity interest in property may be eligible to claim the excess proceeds if any are available. To qualify, you must have had a legal interest in the property at the time of foreclosure. Claims must be submitted within a specific timeframe.
